PM Law Incorporated (“PM Law”, “we”, “us”) is an incorporated firm of attorneys practising in Durban, KwaZulu-Natal. For the purposes of the Protection of Personal Information Act 4 of 2013 (“POPIA”) we are the responsible party for the personal information described in this notice.

Information you give us. When you complete the enquiry form on this website we collect your first and last name, email address, telephone number, the area of law your enquiry concerns, and whatever you choose to tell us in the description field. If you contact us by telephone, email or WhatsApp we collect the information contained in that correspondence.
Information we collect automatically. Our web host records standard technical information when you visit, including your IP address, browser type, the pages you view and the date and time of your visit. This is used to keep the website secure and working, not to identify you personally.
Information you give us as a client. If you instruct us, we will collect the further information needed to act for you. That collection is governed by our mandate and by the Legal Practice Act 28 of 2014 and FICA, and is dealt with separately from this website notice.
We use enquiry information solely to respond to you, to assess whether we are able to assist, and to open a file if you instruct us. We process it because it is necessary to take steps at your request before entering into a contract, and because it is necessary for our legitimate interest in responding to people who approach the firm.
We do not use your information for marketing, and we do not sell it or make it available to third parties for their own purposes.
An enquiry about a Road Accident Fund claim or a medical negligence claim may lead you to tell us about your health or injuries. Information concerning health is special personal information under section 26 of POPIA. Please share only what is necessary at the enquiry stage. Where we process such information, we do so because it is necessary for the establishment, exercise or defence of a right or obligation in law, or with your consent.
We share personal information only where it is necessary and lawful to do so — for example with counsel, correspondent attorneys, medico-legal experts, the Road Accident Fund, a court or tribunal, or our IT and email service providers acting as operators on our instruction. Everyone who receives information from us is required to keep it confidential.
Attorney–client communications remain subject to legal professional privilege.
Enquiries that do not become instructions are kept only as long as needed to deal with the enquiry and to keep a record of it, and are then deleted. Where you become a client, the file is retained for the period required by the Legal Practice Act, the rules of the Legal Practice Council and any other applicable law, after which it is securely destroyed.
We apply reasonable technical and organisational measures to protect personal information against loss, unlawful access and unauthorised disclosure, as required by section 19 of POPIA. No transmission over the internet can be guaranteed to be completely secure, so please do not send us sensitive documents by unencrypted email unless you are content to accept that risk.
This website uses only the cookies necessary for it to function. We do not use advertising or profiling cookies. You can block or delete cookies in your browser settings, though parts of the site may then not work as intended.
Under POPIA you may ask us what personal information we hold about you and request access to it; ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained; object to our processing on reasonable grounds; and withdraw any consent you have given, without affecting processing already carried out.
To exercise any of these rights, contact our Information Officer at info@pmlegal.co.za. A request for access is made on the form prescribed under the Promotion of Access to Information Act 2 of 2000, and a prescribed fee may apply.
If you are not satisfied with how we have handled your personal information, please raise it with us first so that we can try to resolve it. You are also entitled to complain to the Information Regulator:
